1. Acceptance of Terms
By accessing, browsing, or using the FareEagle website ("www.fareeagle.com"), mobile application, Telegram bot, AI assistant (Aira), or any services offered by FareEagle (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and FareEagle ("we", "us", "our", "Company"), governed by the laws of India including but not limited to the Information Technology Act, 2000 and the Consumer Protection Act, 2019.
Your use of the Platform constitutes an electronic record within the meaning of the Information Technology Act, 2000, and the rules thereunder, as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signature.
2. Definitions
In these Terms, unless the context otherwise requires:
- "Platform" means the FareEagle website (www.fareeagle.com), progressive web application, Telegram bot, AI assistant (Aira), APIs, and all associated services.
- "Service Provider" means any airline, hotel, bus operator, or other third-party travel service provider whose services are listed on or accessible through the Platform.
- "Booking" means any reservation of flights, hotels, bus tickets, or bundled travel packages (Trip Bundles) made through the Platform.
- "Trip Bundle" means a combined booking of flights and hotels made together through the trip planning feature of the Platform.
- "User" means any individual, agency, or entity that accesses or uses the Platform.
- "Agency" means a registered travel agency using the FareEagle Agency Panel, governed by a separate Agency Agreement.
- "Fare" means the total price payable for a Booking, inclusive of base price, taxes, surcharges, and any applicable service fees.
- "PNR" means Passenger Name Record, a unique identifier issued by the airline upon confirmed booking.
- "Service Fee" means the convenience or processing fee charged by FareEagle for facilitating the Booking.
- "FareEagle Processing Charges" means the charges applied by FareEagle for processing cancellations and refunds, displayed to you before you confirm any cancellation.
- "FareEagle Wallet" means the digital wallet facility provided within the Platform for storing credits, receiving refunds, and making payments.
- "Aira" means FareEagle's AI-powered travel assistant that helps Users search, compare, and plan travel.
3. Nature of Services
FareEagle operates as an online travel aggregator and intermediary within the meaning of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We facilitate the search, comparison, and booking of travel services including flights, hotels, and bus tickets. We also offer AI-powered trip planning, price monitoring, and travel recommendation services.
Important: FareEagle does not own, operate, or manage any aircraft, hotel property, or bus service. The actual transportation, accommodation, or travel service is provided solely by the respective Service Provider. Your contract of carriage or accommodation is directly with the Service Provider, and their terms, conditions, and policies apply in addition to these Terms.
As an intermediary, FareEagle facilitates transactions between Users and Service Providers. We source fares, availability, and schedule information from Service Providers through their APIs and global distribution systems. While we strive for accuracy, we cannot guarantee that all information displayed is error-free at all times.
FareEagle's services are accessible through multiple channels including the website, progressive web application (PWA), Telegram bot, and the Aira AI assistant. These Terms apply equally to all channels.
3.1 Country of Origin Disclosure
In compliance with Rule 6(3)(a) of the Consumer Protection (E-Commerce) Rules, 2020, FareEagle discloses the country of origin / country of operation for travel services as follows:
- Flights: The country in which the airline is registered (e.g., "Air India — India," "Emirates — United Arab Emirates") is shown on each search result and booking review page.
- Hotels: The country and city of the hotel property is shown on each result card and at the booking review page.
- Buses: All bus services facilitated by FareEagle currently operate within India (country of operation: India).
- FareEagle: The consumer travel brand of Ishaanvi Holidays Private Limited, a company incorporated in India under the Companies Act, 2013 (CIN: U79120AP2026PTC127726), with its registered office at D No 12-29-6, Opp. Kothapeta Police Station, Kothapeta, Guntur, Andhra Pradesh 522001, India.
The country of origin filter mechanism contemplated in the E-Commerce Rules is applied at the Service Provider level — Users may filter or compare options by airline or hotel chain, each of which carries its country of origin in the result metadata.
4. Eligibility
To use the Platform and make Bookings, you must:
- Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher.
- Be competent to enter into a binding contract under the Indian Contract Act, 1872 (i.e., not a minor, person of unsound mind, or person disqualified from contracting by law).
- If acting on behalf of an organisation (e.g., a travel agency), have the authority to bind that organisation to these Terms.
- Provide accurate, current, and complete information during registration and booking.
Minors (persons under 18) may use the Platform only under the supervision of a parent or legal guardian. The parent or guardian is responsible for all activity under the minor's account and for ensuring the accuracy of booking information.
5. User Accounts
- Registration requires a valid email address or phone number. You may also register or log in using supported third-party authentication (e.g., Google).
- You are solely responsible for maintaining the confidentiality of your account credentials. Any activity under your account is deemed authorised by you.
- You must immediately notify FareEagle of any unauthorised use of your account by contacting our support team.
- FareEagle reserves the right to suspend, restrict, or terminate any account that violates these Terms, engages in fraudulent activity, or is used to abuse promotional offers.
- One person may hold only one active user account. Duplicate accounts created to exploit offers or circumvent restrictions may be terminated without notice.
- Upon account creation, a FareEagle Wallet is automatically provisioned for your account. See Section 7 (FareEagle Wallet) for applicable terms.
- You may add and manage saved traveller profiles under your account for faster bookings. You are responsible for the accuracy of all saved traveller information.
5.1 Account Deletion
You may request deletion of your account by contacting our support team. Upon deletion: (a) any active bookings must first be completed or cancelled, (b) any remaining wallet balance will be refunded to your original payment method within 14 business days, (c) your personal data will be handled in accordance with our Privacy Policy and applicable data retention requirements under Indian law.
6. Booking, Pricing & Payment
6.1 Pricing
- All fares displayed on the Platform are in Indian Rupees (INR) unless otherwise stated.
- Prices are sourced in real-time from Service Providers and are subject to change without prior notice until payment is completed.
- The total price displayed at checkout includes the base fare, applicable government taxes (including GST where applicable), airline/operator surcharges, and the FareEagle Service Fee.
- FareEagle does not guarantee that the fare displayed during search will remain available at the time of payment. Fares are confirmed only upon successful completion of payment and issuance of a valid PNR or booking confirmation.
- Price estimates provided by the Aira AI assistant are indicative and based on available data at the time of the query. Actual prices may vary at the time of booking.
6.2 Booking Confirmation
- A Booking is considered confirmed only when: (a) payment has been successfully processed, (b) a valid PNR or booking reference has been issued, and (c) a confirmation email/notification has been sent to your registered email.
- In rare cases, a fare may become unavailable between the time of payment initiation and payment completion ("phantom fare"). In such cases, FareEagle will initiate a full refund of the amount paid within 5–7 business days.
- You are responsible for providing accurate passenger details including full legal name (as per government-issued ID), date of birth, gender, and contact information. Errors in passenger details may result in denied boarding, and FareEagle shall not be held liable for consequences arising from incorrect information provided by you.
- For international bookings, you are additionally responsible for providing accurate passport details (number, expiry date, nationality). Incorrect passport information may result in denied boarding or entry refusal.
6.3 Payment
- Accepted payment methods include UPI, credit cards, debit cards, net banking, FareEagle Wallet balance, and any other method made available on the checkout page.
- All payments are processed exclusively through Payment Aggregators authorised by the Reserve Bank of India under the Master Direction on Regulation of Payment Aggregators and Payment Gateways (RBI/2025-26/45 dated 15 September 2025, and subsequent amendments). FareEagle does not store full card numbers, CVV, expiry, or bank account credentials at any time. All cardholder data is handled by our PCI-DSS Level 1 compliant Payment Aggregator partner.
- Payment processing charges, if any, are borne by the User and are non-refundable.
- In compliance with RBI guidelines on digital payments, all transactions are subject to two-factor authentication where applicable, including additional factor authentication (AFA) under RBI's framework for card-not-present transactions.
- If a payment is debited but the booking is not confirmed due to a technical failure, the amount will be auto-reversed within 5 business days as per RBI Turn Around Time (TAT) guidelines for failed transactions (RBI/2019-20/67 dated 20 September 2019).
- Customers must initiate cancellation requests through FareEagle's support channels before approaching the issuing bank for a chargeback. See Section 26A (Chargeback Policy) for the full chargeback dispute process.
6.4 Goods and Services Tax (GST)
GST is applicable on the FareEagle Service Fee as per prevailing rates under the Central Goods and Services Tax Act, 2017 and respective State GST Acts. The applicable GST will be clearly displayed in the fare breakdown before payment. A tax invoice is generated for every booking and can be downloaded from your dashboard.
7. FareEagle Wallet
FareEagle provides a digital wallet facility ("FareEagle Wallet") for your convenience. The Wallet is not a bank account, prepaid payment instrument, or deposit scheme. It is a ledger maintained by FareEagle to track credits issued to you.
7.1 Wallet Credits
- Credits may be added to your Wallet through: (a) refunds processed to your Wallet instead of your original payment method, (b) promotional credits or cashback offers, (c) manual top-up through supported payment methods, where available.
- Wallet balance can be used to pay for bookings on the Platform, either fully or partially in combination with other payment methods.
- Wallet credits are denominated in Indian Rupees (INR) and are non-transferable to other users.
7.2 Wallet Limitations
- Wallet balance cannot be withdrawn as cash or transferred to a bank account, except upon account deletion (see Section 5.1).
- Promotional credits may carry specific terms such as minimum booking value, service type restrictions, or expiry dates. These terms will be communicated at the time the credit is issued.
- FareEagle reserves the right to reverse Wallet credits that were issued in error, obtained through fraudulent activity, or resulted from a transaction that was subsequently reversed or charged back.
7.3 Wallet & Refunds
When you cancel a booking that was paid using Wallet balance, the refundable amount (after deduction of applicable cancellation charges) will be credited back to your Wallet. For bookings paid with a combination of Wallet and another payment method, refunds are applied proportionally to each method.
8. Cancellation, Refunds & Modifications
Detailed cancellation charges, refund timelines, and modification policies are set out in our Cancellation & Refund Policy, which forms an integral part of these Terms.
8.1 Flight Cancellations
- Cancellation charges depend on the fare rules set by the airline for your specific ticket. Non-refundable fares may only receive a partial tax refund, if any.
- Cancellation charges comprise the airline's cancellation fee, FareEagle processing charges, and a non-refundable payment processing fee. The exact breakdown of all charges is shown before you confirm any cancellation.
- If the airline cancels your flight (airline-initiated cancellation), you are entitled to a full refund with no charges from FareEagle.
8.2 Hotel Cancellations
- FareEagle offers reduced cancellation charges within 48 hours of booking for hotel reservations. This 48-hour window does not apply to last-minute bookings where check-in falls within 48 hours of the booking time.
- Hotel cancellation penalties vary by property and rate plan. Non-refundable room rates are clearly labelled during booking, and the hotel may retain the full room charge upon cancellation.
- A payment processing fee is deducted from all hotel refunds. FareEagle processing charges also apply.
- The exact cancellation charges are displayed during the cancellation process before you confirm.
8.3 Bus Cancellations
- Bus operators set their own tiered cancellation policies. Cancellation charges are typically a percentage of the ticket price and increase as the departure time approaches. Each operator determines their own tiers.
- The operator's cancellation policy and the exact charges for your booking are calculated and displayed during the cancellation process before you confirm.
- A payment processing fee and FareEagle processing charges are deducted from all bus refunds.
8.4 Add-on Services (SSR)
- Pre-booked add-on services including meals, seat selections, and extra baggage are fully non-refundable upon cancellation, regardless of when the cancellation is made or whether the service was used.
- The full add-on amount is deducted from the refund during cancellation processing.
- This policy applies to all booking types — flights, hotels, and buses.
- The non-refundable nature of add-ons is communicated during the add-on selection process before purchase.
8.5 General Refund Terms
- Cancellation requests must be submitted through your FareEagle dashboard (My Bookings → View Details → Cancel Booking) or by contacting our support team.
- Refunds are processed to the original payment method within 5–7 business days, subject to the payment provider's processing timelines. Refunds for Wallet-paid bookings are credited to your Wallet instantly.
- Refund amounts are determined by the fare rules or cancellation policies of the specific ticket or booking, which are communicated at the time of purchase and displayed before cancellation confirmation.
- If a Service Provider rejects a booking after payment has been collected, FareEagle will initiate a full refund and notify you by email and SMS.
- FareEagle processes cancellations on a best-effort basis. Final refund amounts are determined by the airline, hotel, or bus operator.
Consumer Right: Under the Consumer Protection Act, 2019 (Section 2(9)), you have the right to be informed of the charges, terms and conditions at the time of purchase. FareEagle displays all applicable fees, charges, and fare rules transparently before you confirm any booking or cancellation.
9. Travel Documents & Passenger Responsibilities
It is your sole responsibility to ensure that:
- You carry a valid government-issued photo identification for domestic travel within India (Aadhaar, PAN Card, Passport, Voter ID, Driving Licence, or any other ID accepted by the airline as per DGCA guidelines).
- For international travel, you hold a valid passport with a minimum of 6 months' validity from the date of return, along with all required visas, transit permits, and entry clearances for your destination and transit countries.
- You comply with all health and vaccination requirements, including COVID-19 or other pandemic-related regulations, as mandated by origin, transit, and destination countries.
- You arrive at the airport/boarding point with sufficient time before departure as recommended by the Service Provider.
- For minors travelling without both parents, you carry appropriate documentation including consent letters, birth certificates, or guardianship orders as required by the airline or immigration authorities.
- For bus travel, you carry a valid government-issued photo ID and the booking confirmation (digital or printed) as required by the bus operator.
FareEagle is not liable for denied boarding, deportation, detention, or any costs arising from your failure to carry adequate or valid travel documentation.
10. Flights, Hotels & Buses — Specific Terms
10.1 Flight Bookings
- Flight bookings are subject to the airline's Contract of Carriage, which governs your rights and obligations as a passenger.
- In accordance with DGCA (Directorate General of Civil Aviation) regulations, airlines are obligated to provide certain minimum facilities in case of flight delays and cancellations. FareEagle will assist you in seeking redressal from the airline but is not directly liable for airline operational decisions.
- Passengers are advised to verify flight status and any schedule changes directly with the airline before travelling.
- Special service requests (wheelchair assistance, unaccompanied minor, medical requirements) must be requested at the time of booking or at least 48 hours before departure. Fulfilment depends on the airline's capabilities and cannot be guaranteed by FareEagle.
- Frequent flyer miles or loyalty points accrual is subject to the airline's loyalty programme terms and is not managed by FareEagle.
- For round-trip bookings, domestic flights may be issued as two separate one-way PNRs, while international flights are typically issued as a single PNR. Cancellation of one leg does not automatically cancel the other; each must be managed separately.
10.2 Hotel Bookings
- Hotel bookings are subject to the property's own terms, check-in/check-out policies, age restrictions, and local regulations.
- Room types, amenities, photos, and descriptions are provided by the hotel or its distribution partners. FareEagle strives for accuracy but cannot guarantee that all property information is current.
- Early check-in, late check-out, room upgrades, and other special requests are subject to availability at the property and cannot be guaranteed.
- Some hotels require valid ID proof or a credit card at check-in. Please verify the property's requirements before travelling.
- For multi-room bookings, all rooms in the reservation are subject to the same cancellation policy. Partial cancellation (cancelling some rooms but not others) may not be supported depending on the hotel's policy.
10.3 Bus Bookings
- Bus bookings are governed by the bus operator's terms and conditions. The operator is solely responsible for the condition of the vehicle, punctuality, routing, and on-board services.
- Boarding points, dropping points, and scheduled timings are subject to change by the operator. FareEagle will communicate any changes received from the operator but cannot guarantee timely notification of all changes.
- FareEagle is not responsible for delays, breakdowns, route diversions, or quality of service provided by bus operators.
- Seat selection is available during booking. Seat assignments are subject to the bus operator's final layout and may differ in rare cases from what was shown during booking.
11. Trip Bundles (Flight + Hotel Packages)
FareEagle offers the ability to book flights and hotels together as a Trip Bundle through the trip planning feature. The following additional terms apply:
- Independent Bookings: A Trip Bundle consists of separate flight and hotel bookings made through a single checkout process. Each component is booked independently with the respective Service Provider and is governed by that provider's own terms and conditions.
- Trip Bundles are not tour packages within the meaning of any tourism regulation. FareEagle is not a tour operator. No unified contract of travel exists between you and FareEagle for the bundled services.
- Partial Failure: In the event that one component of a Trip Bundle is confirmed but the other fails (e.g., flight books successfully but hotel booking fails), FareEagle will notify you immediately. You may choose to proceed with the confirmed component or cancel it. If you choose to cancel, standard cancellation charges for the confirmed component will apply.
- Cancellation: Each component of a Trip Bundle must be cancelled separately. Cancelling your flight does not automatically cancel your hotel booking, and vice versa. Standard cancellation policies and charges apply to each component independently.
- Pricing: The total Trip Bundle price is the sum of the individual flight and hotel prices, including applicable taxes, service fees, and FareEagle processing charges. There is no additional bundling fee.
12. Aira — AI Travel Assistant
Aira is an AI-powered travel assistant available on the Platform. By using Aira, you agree to the following:
12.1 Nature of Service
- Aira provides travel suggestions, trip plans, destination information, and fare estimates using artificial intelligence. Aira's responses are generated by a large language model and are provided for informational and convenience purposes only.
- Aira is not a licensed travel advisor and its recommendations do not constitute professional travel advice. FareEagle does not guarantee the accuracy, completeness, or timeliness of information provided by Aira.
- Price estimates, travel durations, weather information, and destination details provided by Aira are approximate and may differ from actual conditions at the time of travel.
12.2 Data Usage
- Conversations with Aira are stored to improve service quality, personalise recommendations, and for troubleshooting purposes. Conversations are retained in accordance with our Privacy Policy.
- Aira may use your search history, booking history, and stated preferences to provide personalised travel recommendations. You can request deletion of your Aira conversation history by contacting support.
- Aira conversations initiated through third-party platforms (e.g., Telegram) are subject to both FareEagle's and the respective platform's privacy policies.
12.3 Limitations
- Aira may occasionally generate inaccurate or outdated information. Always verify critical travel details (visa requirements, health advisories, flight schedules) through official sources before making travel decisions.
- Aira does not process payments or complete bookings directly. When you are ready to book, Aira will redirect you to the booking page where you complete the transaction yourself.
- FareEagle reserves the right to limit, modify, or discontinue Aira's features at any time without prior notice.
FareEagle may from time to time offer promotional codes, coupons, cashback offers, or discounts ("Promotions"). The following terms apply to all Promotions unless specific terms are stated at the time of the offer:
- Promotions are valid only during the specified validity period and cannot be used after expiry.
- Promotions are non-transferable, cannot be exchanged for cash, and cannot be combined with other Promotions unless explicitly stated.
- Each Promotion may have specific conditions including minimum booking value, applicable service types (flights, hotels, or buses), maximum discount amount, and per-user usage limits.
- FareEagle reserves the right to revoke, modify, or discontinue any Promotion at any time without prior notice.
- If a booking made using a Promotion is cancelled, the refund will be calculated on the amount actually paid after the discount. The promotional discount or cashback will be forfeited and will not be re-issued unless explicitly stated.
- Misuse of Promotions — including creating multiple accounts, using automated tools, or exploiting technical errors — may result in forfeiture of the promotional benefit, account suspension, and potential legal action.
14. Price Alerts & Notifications
- FareEagle allows you to set price alerts for specific routes or destinations. When fares match your criteria, you will receive notifications via email, SMS, or push notification based on your preferences.
- Price alerts are informational and do not guarantee that the alerted fare will be available at the time you attempt to book. Fares are subject to real-time availability and may change before you complete the booking.
- You may manage, pause, or delete your price alerts at any time from your dashboard.
- FareEagle uses your price alert data to understand travel demand patterns and improve service quality. This data is handled in accordance with our Privacy Policy.
15. Reviews & User-Generated Content
FareEagle may allow you to submit reviews, ratings, photos, or other content ("User Content") related to your travel experiences. By submitting User Content, you agree to the following:
- You grant FareEagle a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, modify, and distribute your User Content on the Platform and in marketing materials.
- You represent that your User Content is truthful, based on your genuine experience, and does not infringe any third party's intellectual property or privacy rights.
- You shall not submit User Content that is defamatory, abusive, obscene, discriminatory, fraudulent, or that violates any applicable law.
- FareEagle reserves the right to moderate, edit, or remove any User Content at its sole discretion, including content that violates these Terms, is reported by other users, or is deemed harmful.
- FareEagle does not endorse or verify User Content and is not liable for any claims arising from User Content submitted by you or other users.
16. Shared Bookings
FareEagle allows you to share your booking details with others via a secure shareable link. By using this feature:
- You acknowledge that anyone with the shareable link can view the booking details included in the share (such as flight/hotel details, dates, passenger names, and booking status).
- Shared booking links do not grant the recipient any ability to modify, cancel, or manage the booking. Only the account holder can perform such actions.
- You are solely responsible for controlling who you share the link with. FareEagle is not liable for any consequences arising from unauthorised access to a shared link.
- FareEagle may deactivate shared links after a reasonable period of inactivity or upon your request.
- Sensitive information such as payment details, full passport numbers, or Aadhaar numbers are never included in shared booking views.
17. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- FareEagle acts solely as an intermediary and is not liable for any act, omission, negligence, default, or breach by any Service Provider including airlines, hotels, and bus operators.
- FareEagle shall not be liable for flight delays, cancellations, schedule changes, overbooking, denial of boarding, lost baggage, poor hotel conditions, bus breakdowns, or any other operational issue caused by the Service Provider.
- FareEagle's total aggregate liability for any claim arising out of or in connection with these Terms shall not exceed the total amount paid by you for the specific Booking giving rise to the claim.
- FareEagle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
- The Platform is provided on an "as is" and "as available" basis. FareEagle does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
- FareEagle is not liable for any losses or damages arising from reliance on information, recommendations, or estimates provided by the Aira AI assistant.
- FareEagle is not liable for any loss arising from the sharing of booking details through the shared booking feature, where such sharing was initiated by the User.
Note: Nothing in these Terms shall exclude or limit liability in any way that is not permitted under Indian law, including under the Consumer Protection Act, 2019, or for claims arising from gross negligence or wilful misconduct.
18. Indemnification
You agree to indemnify, defend, and hold harmless FareEagle, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms or any applicable law.
- Your use of the Platform or any Service Provider's services booked through the Platform.
- Inaccurate, incomplete, or misleading information provided by you during registration or booking.
- Your violation of the rights of any third party.
- Any fraudulent or illegal activity conducted through your account.
- User Content submitted by you that infringes any third party's rights or violates applicable law.
19. Intellectual Property
All content on the Platform — including but not limited to the website design, logos, trademarks, trade names, text, graphics, images, software, source code, data compilations, AI models, and algorithms — is the exclusive property of FareEagle or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international intellectual property laws.
- You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any content on the Platform without prior written permission from FareEagle.
- The FareEagle name, logo, and tagline ("Pay Less, Soar More") are registered or unregistered trademarks of FareEagle and may not be used without authorisation.
- "Aira" is a trademark of FareEagle. Third parties may not use the Aira name or branding without express written consent.
- Any unauthorised use of the Platform's content may result in legal action under the applicable provisions of the Copyright Act, 1957 and the Information Technology Act, 2000.
20. Privacy, Data Protection & Cookies
Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal information in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Digital Personal Data Protection Act, 2023 (as and when notified).
By using the Platform, you consent to the collection and use of your data as described in our Privacy Policy. We may share certain booking-related information with Service Providers to fulfil your Booking.
20.1 Cookies & Tracking
- The Platform uses cookies, local storage, and similar tracking technologies to provide essential functionality (session management, authentication), remember your preferences, analyse usage patterns, and improve service quality.
- We use third-party analytics services to understand how Users interact with the Platform. These services may collect information about your browsing behaviour, device type, and approximate location.
- By continuing to use the Platform, you consent to the use of cookies and tracking technologies as described in our Privacy Policy.
- You may disable cookies through your browser settings, but this may affect the functionality of the Platform.
21. Communications & Notifications
By creating an account or making a booking on FareEagle, you consent to receive communications from us through the following channels:
- Transactional communications: Booking confirmations, e-tickets, cancellation receipts, refund notifications, payment receipts, schedule changes, and check-in reminders sent via email and SMS. These are essential to the service and cannot be opted out of while you have active bookings.
- Service notifications: Price alerts, booking reminders, review prompts, and account security alerts sent via email, SMS, push notification, or in-app notification based on your preferences.
- Promotional communications: Offers, deals, travel inspiration, and newsletter content sent via email or SMS. You may opt out of promotional communications at any time by clicking "Unsubscribe" in any email or by updating your notification preferences in your dashboard.
FareEagle sends SMS communications in compliance with the Telecom Regulatory Authority of India (TRAI) regulations. Transactional messages are sent via registered routes and are not subject to DND (Do Not Disturb) filters. Promotional messages comply with TRAI's DND regulations and are not sent to numbers registered on the National Do Not Call Registry unless you have explicitly opted in.
22. Third-Party Services & Platforms
The Platform may contain links to or integrations with third-party websites, applications, or services (including payment gateways, airlines, hotels, and bus operators). FareEagle does not control, endorse, or assume responsibility for the content, policies, or practices of any third-party services. Your interactions with such services are governed by their respective terms and policies.
22.1 Telegram Bot
FareEagle's Telegram bot provides access to Aira and certain booking features within the Telegram messaging platform. By using the Telegram bot:
- You acknowledge that your interactions are subject to both FareEagle's Terms and Telegram's Terms of Service and Privacy Policy.
- Messages sent to the FareEagle Telegram bot are processed by FareEagle's servers. Message content is stored in accordance with our Privacy Policy for service improvement and support purposes.
- The Telegram bot may send you notifications about your bookings, travel updates, and promotional offers. You can stop receiving messages by blocking the bot on Telegram or by contacting our support team.
23. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.
- Provide false, inaccurate, or misleading information during registration or booking.
- Create multiple accounts to exploit promotional offers, discounts, or referral programmes.
- Attempt to gain unauthorised access to other user accounts, computer systems, or networks connected to the Platform.
- Use any automated means (bots, scrapers, crawlers) to access, monitor, or copy any content on the Platform without express written consent.
- Interfere with or disrupt the Platform, its servers, or any networks connected to it.
- Use the Platform to transmit spam, malware, or any harmful code.
- Engage in fraudulent booking practices, including but not limited to use of stolen payment credentials, manipulation of fares, or exploitation of pricing errors.
- Resell or commercially exploit Bookings made through the Platform without authorisation.
- Abuse the Aira AI assistant by submitting harmful, offensive, or illegal content, or by attempting to manipulate Aira's responses for purposes unrelated to travel.
- Submit false reviews, ratings, or User Content designed to mislead other users or manipulate the Platform's recommendation systems.
- Exploit the price alert system to conduct automated fare monitoring for commercial purposes without authorisation.
Violation of these provisions may result in immediate account termination and may attract legal action under the Information Technology Act, 2000 and other applicable laws.
24. Force Majeure
FareEagle shall not be liable for any failure or delay in the performance of its obligations under these Terms due to events beyond its reasonable control, including but not limited to: natural disasters, epidemics, pandemics, war, armed conflict, terrorism, civil unrest, government actions, sanctions, airspace closures, strikes, lockouts, fire, flood, earthquake, power failure, internet or telecommunications outage, cyberattack, or any other force majeure event.
In such circumstances, FareEagle will make reasonable efforts to inform affected Users and facilitate alternative arrangements or refunds as may be applicable.
25. Consumer Rights Under Indian Law
FareEagle recognises and respects your rights as a consumer under the Consumer Protection Act, 2019, including:
- Right to be informed (Section 2(9)(ii)): You have the right to complete information about the quality, quantity, potency, purity, standard, and price of goods or services.
- Right to be heard (Section 2(9)(iv)): You have the right to be heard and to be assured that your interests will receive due consideration.
- Right to seek redressal (Section 2(9)(v)): You have the right to seek redressal against unfair trade practices or unscrupulous exploitation.
- Right to consumer education (Section 2(9)(vi)): You have the right to acquire knowledge and skill to be an informed consumer.
In the event of any deficiency of service, you may approach the appropriate Consumer Disputes Redressal Forum or Commission as established under the Consumer Protection Act, 2019.
DGCA Passenger Charter: For flight-related complaints concerning delays, cancellations, denied boarding, or baggage issues, passengers may also approach the DGCA through the AirSewa portal (airsewa.gov.in) or the DGCA's grievance redressal mechanism as per the Civil Aviation Requirements (CAR) Section 3, Series M, Part IV.
26. Statutory Officers & Grievance Redressal
In compliance with the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 read with the Digital Personal Data Protection Rules, 2025, FareEagle has appointed the following officers, all of whom are residents and citizens of India:

26.4 Grievance Acknowledgement & Resolution Timelines
- Acknowledgement: All consumer grievances are acknowledged within 48 hours of receipt with a tracking reference number.
- Consumer grievances (general): Resolved within 30 days of receipt, in compliance with the Consumer Protection (E-Commerce) Rules, 2020 and IT Rules, 2021.
- DPDP data principal requests (access, correction, erasure, nomination): Resolved within 7 working days of receipt, in compliance with the Digital Personal Data Protection Rules, 2025. If the request requires legal interpretation or third-party coordination, we may extend by up to 14 days with written notice and justification.
- Personal data breach notification: In the event of a personal data breach, we will notify the Data Protection Board of India and affected Data Principals without any delay on becoming aware of the breach, in accordance with the DPDP Rules, 2025.
26.5 Escalation Channels
If you are not satisfied with the resolution provided by FareEagle, you may escalate your complaint to:
- The National Consumer Helpline: 1800-11-4000 or consumerhelpline.gov.in
- The appropriate District, State, or National Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
- For flight-related grievances: DGCA AirSewa portal (airsewa.gov.in) or toll-free number 1800-11-4555.
- For data protection grievances: the Data Protection Board of India, once constituted under the DPDP Act, 2023.
26A. Chargeback & Dispute Resolution Policy
FareEagle is committed to fair and timely resolution of payment disputes. This Chargeback Policy is published in accordance with the Sub-Merchant Agreement with our Payment Aggregator partner and Reserve Bank of India guidelines on dispute resolution.
26A.1 Contact FareEagle Before Initiating a Chargeback
If you have a concern about a charge made on your card or account by FareEagle, we strongly encourage you to contact our support team before initiating a chargeback with your issuing bank. Most disputes can be resolved directly and refunded faster (5–7 business days) than the chargeback process (30–120 days).
- Email [email protected] with your booking reference and a description of the issue.
- We respond to all chargeback-related queries within 48 hours.
- If the dispute is valid, we will issue a refund through your original payment method or FareEagle Wallet as per our Refund Policy.
26A.2 Legitimate Chargeback Reasons
We recognise the following as legitimate grounds for a chargeback dispute:
- Unauthorised use of your card or account (fraud)
- Service not received (e.g., booking confirmation never delivered despite successful payment)
- Duplicate charges that we did not auto-reverse within 7 business days
- Material misrepresentation of the service booked
26A.3 Chargebacks Initiated Without Prior Contact
Chargebacks initiated without first attempting resolution with FareEagle may:
- Trigger automatic suspension of your FareEagle account pending investigation
- Result in cancellation of pending or future bookings under the same account or payment instrument
- Be contested by FareEagle with full evidence (booking confirmation, e-ticket, IP logs, communication records, service delivery proof) submitted to the issuing bank and card networks via our Payment Aggregator
26A.4 Fraudulent or Abusive Chargebacks
Chargebacks initiated on bookings where the service was clearly delivered (e.g., flight actually taken, hotel actually used, bus actually boarded) constitute "friendly fraud" and may attract:
- Permanent ban from the FareEagle Platform
- Legal action under Section 420 of the Indian Penal Code (Cheating) and Section 66D of the Information Technology Act, 2000 (Cheating by personation using computer resource)
- Reporting to credit bureaus, card networks, and industry fraud databases
26A.5 Evidence Preserved for Dispute Resolution
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and best practice for payment disputes, FareEagle preserves the following evidence for every transaction for a minimum of 7 years from the transaction date:
- Booking timestamp, IP address, device fingerprint, browser/app metadata
- Authentication trail (login session, OTP verification where applicable)
- Acceptance of Terms & Conditions and Privacy Policy at the time of booking
- Payment Aggregator transaction reference and authentication metadata
- E-ticket / voucher delivery confirmation (email receipt)
- Communication history (support tickets, emails) related to the booking
- Cancellation requests and refund processing records, where applicable
This evidence is provided to the Payment Aggregator and card networks during chargeback disputes to support the merchant's case where the chargeback is contested.
27. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:
- The Indian Contract Act, 1872
- The Information Technology Act, 2000 and rules made thereunder
- The Consumer Protection Act, 2019
- The Consumer Protection (E-Commerce) Rules, 2020
- The Digital Personal Data Protection Act, 2023 (as and when notified)
Subject to the provisions of the Consumer Protection Act, 2019 (which allow consumers to file complaints at their place of residence), any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Guntur, Andhra Pradesh, India.
28. Severability & Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
The failure of FareEagle to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
29. Changes to Terms
FareEagle reserves the right to modify, amend, or update these Terms at any time. The updated Terms will be posted on this page with a revised "Last updated" date. Material changes will be communicated to registered Users via email or through a prominent notice on the Platform.
Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Platform.
